County talks about tort claim

Payne County Commissioners discussed a tort claim against the county in their meeting Tuesday.

Terry Nunley filed the claim against District Three. A railroad tank car had been adapted for a bridge on 32nd Avenue, but had washed out during a storm, prompting county workers to block off the road. Nunley proceeded around the roadblock, attempting to jump the tank car, but got his vehicle stuck on the bridge.

Nunley seeks $18,000 in damages, including $4,500 for lost wages, $5,000 for missing work, $750 for insurance deductions and $10,000 for pain and suffering.

Right-of-way public utility and encroachment agreements were also discussed in the meeting.

The agreements concern Second Mount Vernon District One, at 2.25 miles south of S.H. 51 on Euchee Valley Road, and Berger Bridge District One, located on a tributary of Mud Creek, one mile north of S.H. 51 on C Street in Yale, 0.1 of a mile east of McElroy Road.

At 10 a.m. the commissioners accepted bids for renovations of livestock facilities at Payne County Expo Center. Commissioners accepted the bid of Lambert Construction Co. of Stillwater at a price of $177,990.
