2nd man charged in shooting
Laura Wilson - NewsPress
A man was charged in Payne County District Court on Tuesday with possessing a firearm after being convicted of a felony.
Timmy James Bates, 23, is accused of having a Makarov .380 semi-automatic handgun in his possession. He was convicted in 2003 of three counts of burglary of a vehicle, a felony, and one count of obstructing an officer, a misdemeanor.
Bates was arrested after Stillwater police responded to a call about people shooting at each other at 1415 Berry Court on Aug. 10. According to an affidavit signed by Officer Les Little, police found the Makarov at the scene, and Bates told Officer Jeff Dillon that the gun was his.
In an interview at the Stillwater Police Department, Bates told Little that Jamal Porter arrived at the home and began an altercation with another man on the front porch, according to the affidavit. He said he confronted Porter, who pointed a silver .380 handgun at Bates, the affidavit states.
Little wrote that Bates said he thought Porter shot at him, so he fired two shots with his gun at Porter, chased him across a cul-de-sac and fired one or two more shots.
Bates told Little he was a convicted felon and couldn’t own a weapon, and that he bought the gun Aug. 10 in Perry from an unknown person, the affidavit states.
Possession of a firearm after conviction of a felony is punishable by imprisonment for one to 10 years.
Porter was charged Aug. 14 with shooting with intent to kill.
