Sentence deferred in assault case

A Cushing man received a deferred sentence Wednesday on charges of assault and battery and a suspended sentence on charges of driving under the influence of alcohol.

Freddy Gordon Campo, 37, pleaded no contest in June to aggravated assault and battery, a felony charge that stemmed from an incident at a Cushing bar in January 2007, and also to the aggravated DUI charge, a misdemeanor.

He was originally charged with assault and battery with force likely to produce death, but made a plea agreement with the district attorney’s office to plead no contest to aggravated assault and battery, Assistant District Attorney Kathy Thomas told the NewsPress in June. With a plea of no contest, the defendant does not admit guilt but acknowledges the prosecution likely has enough evidence to obtain a conviction.

Campo was accused of assaulting John Austin at Marietta’s Bar in Cushing on Jan. 18, 2007. Austin’s left cheek was fractured, his nose was broken and he received injuries to the base of his skull and spine, according to an affidavit signed by Cushing Police Officer Adam Harp.

The court deferred pronouncement of judgment and sentence for the assault and for three years until Aug. 19, 2011, dependent on conditions Campo must meet. He must pay restitution of $7,939.24, have a drug and alcohol evaluation, complete an anger management course, complete 50 hours of community service within six months and pay court costs.

He will also be under the supervision of the district attorney.

In the DUI case, Campo was sentenced to one year in Payne County Jail, which will be suspended dependent on his good behavior and fulfilling special conditions. He must pay a $350 fine, complete the Alcohol Drug Substance Abuse Course program and a substance abuse evaluation and pay court costs.
