Rape charge filed against Okemah man

An Okemah man has been charged in Payne County with one count of rape in the second degree.

March 30, a warrant of arrest was issued for Marshall Branden Clark, 21, after a counselor reported to the Cushing Police Department that a 14-year-old client of his told him during a session on March 19 that she had sexual intercourse with Clark.

According to court papers, the juvenile spent the night of Feb. 26 at her mother’s house in Cushing to attend a funeral the next day and Clark also stayed there for the same reason.

The 14-year-old claims she slept in a bed with her mentally handicapped sister and Clark, while her mother stayed up through the night on her computer.

After talking, the juvenile claims she had consensual intercourse with Clark and, afterward, was told she would be hurt if she told anyone.

They had sexual intercourse two more times that night and he repeatedly told her he would hurt her if she told anyone.

When asked why she had repeated sex with him, she told authorities she was scared.

Clark was interviewed from the Okfuskee County Jail, where he was being held on separate charges.

According to court papers, Clark claims that the juvenile started kissing him on the neck and trying to put her hands down his pants.

He told her to stop and that he did not want to do anything. She kept trying to kiss him and asking him to mess around at which point he finally rolled over and told her, “OK, just get it over with.”

He claims that he only had intercourse one time with her and the only threat he made was to tell her mother if she did not stop.

If found guilty of this crime, Clark could face one to 15 years in prison.
